OFFICIAL RULES“2017 Wildlife Photography Contest”

The “2017 Wildlife Photography Contest” (the “Contest”) is intended for legal residents of the 50 United States of America (“USA”), including the District of Columbia (“D.C.”), or Canada (excluding the province of Quebec) and shall only be construed and evaluated according to the laws of the USA and Canada.  Void in Puerto Rico and U.S. territories.

SPONSOR/ADMINISTRATOR: The Contest is sponsored by Natural Habitat Adventures, PO Box 3065, Boulder, CO 80307 (the “Sponsor”) and administered by American Sweepstakes & Promotion Co., Inc., 300 State St. Suite 402 Rochester, NY 14614 (the “Administrator”).

ELIGIBILITY: The Contest is open to legal residents of the USA or Canada (excluding the province of Quebec) who are at least eighteen (18) years of age as of May 1, 2017 (the “Entrants”). Residents of Puerto Rico and U.S. territories are not eligible. Employees, officers and representatives of the Sponsor, the Administrator, World Wildlife Fund, Inc., their respective parent companies, employees, independent contractors, officers, directors, subsidiaries, affiliates, distributors, sales representatives and advertising and promotional agencies, and the officers, directors, employees of each of the foregoing, and members of the immediate families (defined as including spouse, biological, adoptive and step-parents, grandparents, siblings, children and grandchildren, and each of their respective spouses, regardless of where they reside) or households (whether related or not) of any of the above (collectively, the “Released Parties”) are NOT eligible to participate in this Contest. Non-eligibility or non-compliance with any of these Official Rules will result in disqualification. Void where prohibited or restricted by law.

AGREEMENT TO OFFICIAL RULES: By participating, Entrants agree to abide by and be bound by these Official Rules and the decisions of the Sponsor, which are final and binding in all matters relating to the Contest.  Winning a Prize (as defined below) is contingent upon fulfilling all the following requirements.                                              

TIMING: The Contest will be defined by the three (3) following time periods:

  1. The Submission Period (“Submission Period”) - 12:00:01 a.m. Mountain Time (“MT”) on May 1, 2017 through May 31, 2017 11:59:59 p.m. MT
  2. The Voting Period (“Voting Period”) - 10:00:01 a.m. MT on June 1, 2017 through 11:59:59 p.m. MT on June 30, 2017.
  3. The Judging Period (“Judging Period”) - 10:00:01 a.m. MT on June 1, 2017 through 11:59:59 p.m. MT on June 30, 2017.

The Sponsor’s database clock is the official time-keeping device for the Contest.

HOW TO ENTER THE CONTEST: Eligible Entrants have the opportunity to enter the Contest by visiting http://dailywildlifephoto.nathab.com/contests/2-2017-wildlife-photo-contest/ (the “Website”). At the Website, Entrants must follow the entry links and instructions to complete the Contest registration form. The registration form will require an Entrant to enter the following information: Full name, complete mailing address, phone number, and email address. In addition, each Entrant must submit a photo pertaining to wildlife (the “Theme”). Submission of a Theme-applicable photo is a mandatory step of Contest Entry.

Submitted photos must contain wildlife, including but not limited to mammals, invertebrates, birds, fish, marine wildlife, insects, and reptiles. Submitted photos may contain people, as long as non-human wildlife is present in the photo. Submitted photos should depict animals in their natural habitat. Please, do not submit photos of animals in captivity, including but not limited to zoos, aquariums, or farms.  Sponsor reserves the right to reject images that are taken in these settings. 

Each successfully completed Contest registration form and Theme-applicable photo submission will result in one (1) Contest entry. Sponsor has the right to not accept/approve submissions deemed inappropriate or not Theme-applicable. Limit three (3) separate photo submissions/entries per person.

ENTRY REQUIREMENTS AND RESTRICTIONS: The Entrant is responsible for all costs associated with uploading the photo. In the event that more than one of the same photo is submitted, only the first submission received shall be accepted. In order to be eligible, entries must actually be received by the Sponsor during the Submission Period.  Entries received by the Sponsor before the start of the Submission Period or after the end of the Submission Period are VOID. Proof of submitting a Contest entry form or photo will not be deemed by Sponsor to constitute proof of actual receipt by Sponsor of an entry. Those who do not follow all of the instructions, do not provide the required information in their entry form, or do not abide by these Official Rules or other instructions of Sponsor may be disqualified. Your submission of an entry constitutes your representation of eligibility, consent to participate in Contest and consent for Sponsor to obtain, use, and transfer your name, contact information, photo and other information for the purpose of Contest administration.  

By submitting an entry, each Entrant: 1) will retain the copyright of the Entrant's submitted photos at all times (Sponsor will never own the copyright to Entrant’s photos); 2) irrevocably grants the Released Parties a royalty-free non-exclusive license throughout the world to use, re-use, copy, publish, republish in whole or in part, edit, add to, modify, and rearrange the entry in whatever media, including without limitation edit, rearrange, and/or copy the entry for use in the Contest or Released Parties’ products and services, without further permission, consideration or payment to the Entrant, except where prohibited; 3) warrants and represents that the Entry is entirely the original creation/work of the Entrant and that use of the Entry as described herein will not violate any law or infringe upon the rights, title, claim or interest of any third party; and 4) certify that Entrant is the creator and sole copyright owner of the Entry.

Entries may not contain any image or depiction of the following: (i) materials which include or constitute trademarks, trade names or copyrighted works created or owned by any person or entity other than Entrant or for which the Entrant has obtained owner’s written permission to use (Sponsor’s discretion); (ii) materials bearing profanities, or bearing the name or likeness of any celebrity, living or dead; (iii) materials which contain visible identifiable or potentially identifiable information, including but not limited to, phone numbers, website links, street addresses, email addresses or license plate numbers; (iv) inappropriate behavior for a general audience; (v) any depiction of real or simulated sexual acts; (vi) violence in any form; (vii) materials which violate anyone’s reasonable privacy expectations, violate any known agreement, or which are defamatory in nature; (viii) materials which are derogatory to Sponsor, or any affiliated entity or person; (ix) materials which are discriminatory based on race, religion, national origin, physical disability, age, sex, or sexual orientation or preference; (x) materials in which any person identifiably appears unless Entrant has obtained an appropriate written release from such person granting all rights required herein; and, (xi) materials which do not comply with all other requirements in these Official Rules. Entries that do not conform to these guidelines will be disqualified. Sponsor reserves the right to reject or disqualify any entry which Sponsor, in its sole and absolute discretion, determines to be inconsistent with the letter or spirit of the Official Rules or potentially damaging to its, the Contest’s, or another’s image or reputation.

Sponsor reserves the right to delete or blur any inappropriate content from a submission without disqualifying the entry where, in Sponsor’s determination, such change does not materially alter the submission and the entrant has otherwise attempted in good faith to comply with these Official Rules.

Image Submission Rules and Guidelines

  • All photos must be original, meaning you may only enter photographs that you took and for which you own the copyright.
  • Photo submissions may be horizontally or vertically oriented. 
  • Photos must be at least 500 KB and at least 1024 pixels on the long edge.
  • Photos must be submitted in JPEG, PNG, or TIFF format. Non-digital formats are not accepted.
  • Sponsor reserves the right to crop photos.
  • Images must not include a border. If an image includes a border, Sponsor reserves the right to crop the border.
  • A subtle watermark in the corner of the image is acceptable, but Sponsor reserves the right to crop photos, which may remove a watermark. The watermark should cover no more than 5% of the photo.
  • Digitally manipulating photos (i.e. cloning, compositing, etc.) should be kept to a minimum. Your photograph must authentically depict the setting as you saw it when you took the photograph. HDR and stitched photos are permitted.

Sponsor reserves the right to make minor alterations to photo titles and descriptions for the purpose of correcting grammatical and spelling mistakes, etc.

GENERAL CONDITIONS: If for any reason the operation or administration of this Contest is impaired or incapable of running as planned for any reason, including but not limited to: (a) infection by computer virus, bugs; (b) tampering, unauthorized intervention; (c) fraud;  (d) technical failures; or (e) any other causes of the Sponsor which corrupt or affect the administration, security, fairness, integrity or proper conduct of this Contest, the Sponsor reserves the right at its sole discretion, to disqualify any individual who tampers with the entry process, and to cancel, terminate, modify or suspend the Contest in whole or in part, at any time, without notice and award the applicable Prizes (defined below) using all non-suspect eligible entries received as of, or after (if applicable) this cancellation, termination, modification or suspension date, or in any manner that is fair and equitable and best conforms to the spirit of these Official Rules.  Sponsor reserves the right, at its sole discretion, to disqualify any individual deemed to be (a) tampering or attempting to tamper with the entry process or the operation of the Contest or Sponsor’s Website; or (b) acting in violation of these Official Rules or in an unsportsmanlike or disruptive manner.

CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES OR OTHER REMEDIES FROM ANY SUCH PERSON(S) RESPONSIBLE FOR THE ATTEMPT TO THE FULLEST EXTENT PERMITTED BY LAW. 

Failure by the Sponsor to enforce any provision of these Official Rules shall not constitute a waiver of that provision.  In the event of a dispute as to the identity of a winner based on an email address, the winning entry will be declared to be the authorized account holder of the email address in question submitted at time of entry. “Authorized account holder” is defined as the natural person who is assigned to an email address by an Internet access provider, online service provider or other organization (e.g., business, educational, institution, etc.) that is responsible for assigning email addresses for the domain associated with the submitted email address.

RELEASE AND LIMITATIONS OF LIABILITY: By participating in the Contest, Entrants agree to release and hold harmless the Released Parties from and against any claim or cause of action arising out of participation in the Contest or receipt or use of any prize, including, but not limited to: (a) any technical errors that may prevent an Entrant from submitting an entry; (b) unauthorized human intervention in the Contest; (c) printing errors; (d) errors in the administration of the Contest or the processing of entries; or (e) injury, death, or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from Entrant’s participation in the Contest or receipt of any prize.  Released Parties assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries. Released Parties are not responsible for any problems or technical malfunction of any telephone network or telephone lines, computer online systems, servers, or providers, computer equipment, software, failure of any email or entry to be received by Sponsor on account of technical problems, human error or traffic congestion on the Internet or at any Website, or any combination thereof, including any injury or damage to the Entrant’s or any other person’s computer relating to or resulting from participation in this Contest or downloading any materials in this Contest.  Entrant further agrees that in any cause of action, the Released Parties’ liability will be limited to the cost of entering and participating in the Contest, and in no event shall the Released Parties be liable for attorney’s fees.  Entrant waives the right to claim any damages whatsoever, including, but not limited to, punitive, consequential, direct, or indirect damages.

WINNER DETERMINATION/NOTIFICATION: Voting Period - Following the conclusion of the Submission Period, the Sponsor will commence the Voting Period of the Contest. During this time, the Sponsor will make all eligible Contest entries available for public voting within the Contest tab/application. The general public will be invited to visit the Website and vote for the entry that they find most deserving of the People’s Choice Grand Prize (defined below). A voter must be a legal resident of the U.S. or Canada. All votes must be made from within the U.S. and Canada. The Sponsor reserves the right to disqualify votes that are made from computers with non-U.S. and non-Canadian IP addresses. Limit one (1) vote per person, per email address per day. Sponsor reserves the right, at its sole discretion, to disqualify any vote(s)/voter(s) deemed to be (a) tampering or attempting to tamper with the Voting process; (b) submitting more than the maximum number of votes allowed per day; or (c) violating these Official Rules in any way. In addition, Entrants (or voters) are not allowed to use or promote the use of any voting board or voting forum to increase their vote total. Any Entrant/voter suspected of using or promoting use of a voting board or voting forum may be subject to disqualification, at the Sponsor’s sole discretion. Entrants/voters may not incentivize voting through the use of personal giveaways, Sweepstakes, or Contests. Any Entrant found attempting to violate or encourage violation of the voting limits and restrictions will be disqualified. The Entrant that receives the most votes during the Voting Period will be named potential People’s Choice Grand Prize Winner. The Entrants that receive the 2nd, 3rd, and 4th most votes (respectively) will be named potential Honorable Mention Prize Winners. Regardless of the results of the Voting Period, ultimate Winner determination is subject to the Sponsor’s approval. The potential People’s Choice Grand Prize Winner will be contacted by the Sponsor and/or Administrator via phone, email and/or by USPS mail. The potential Honorable Mention Prize Winners will each be contacted by the Sponsor via phone, email and/or by USPS mail.

Voting Sweepstakes - By properly submitting a vote (as defined above) during the Voting Period, each voter will automatically receive one (1) Sweepstakes entry. Following the conclusion of the Voting Period, a random drawing will be conducted from among all eligible entries received throughout the Voting Period. The drawing will be conducted by the Administrator, whose decisions are final and binding. The Prize drawing will be conducted on or about July 5, 2017. One (1) potential Voting Sweepstakes Winner will be selected in the drawing. The potential Voting Sweepstakes Winner will be contacted by the Sponsor via phone, email and/or by USPS mail. Odds of winning the Voting Sweepstakes Prize will depend on the total number of eligible entries received throughout the Voting Period.

Judging Period - Following the conclusion of the Submission Period, the Sponsor will also commence the Judging Period of the Contest. During the Judging Period, each entry will be reviewed by a qualified judge or panel of judges appointed by the Sponsor. Each entry will be judged based on the clear relationship between the submission and the following criteria:

  • Originality (20%)
  • Technical Distinction (20%)
  • Superior Composition (20%)
  • Artistic Excellence (20%)
  • Overall Impression (20%)

The Entrant that receives the highest score based on the Judges’ review will be deemed the potential Experts’ Choice Grand Prize Winner. The Entrants that receive the highest score from the judges in each of the above categories will be named potential Honorable Mention Prize Winners. LIMIT ONE (1) PRIZE PER ENTRANT. If the selected Winner received the highest score in any category, the Entrant with the 2nd highest score for the category in question will be deemed the potential Honorable Mention Prize Winner (for that category). The potential Experts’ Choice Grand Prize Winner will be contacted by the Sponsor and/or Administrator via phone, email and/or by USPS mail. The potential Honorable Mention Prize Winners will each be contacted by the Sponsor via phone, email and/or by USPS mail.

PRIZES & PRIZE CONDITIONS: There will be one (1) Experts’ Choice Grand Prize, one (1) People’s Choice Grand Prize, and one (1) Voter Sweepstakes Prize, and eight (8) Honorable Mention Prizes awarded. The Experts’ Choice Grand Prize Winner, upon the Administrator’s confirmation of eligibility, will receive an 8day/7night trip for one (1) person on the Sponsor’s Great Alaskan Grizzly Photo Adventure starting in Kodiak or Homer, AK (the “Location”). The Prize package includes:

(a) One (1) roundtrip standard economy airfare ticket from a major commercial airport in the United States or Canada, near the Winner’s primary residence and the Location, as determined by Sponsor (Sponsor reserves the right to substitute ground transportation for air transportation if Winner resides within 150 miles of the Location);

(b) Roundtrip floatplane flights from the Location to Katmai National Park, Alaska

(c) Accommodations for seven (7) nights in a shared twin*;

(d) All food and meals from dinner on Day 1 through breakfast on the final day;

(e) Purified drinking water;

(f) Beer and wine aboard the boat;

(g) Use of chest waders for shore excursions;

(h) Services of NHA Expedition Leaders, local guides, and boat crew;

(i) Airport ground transportation;

(j) All activities and entrance fees;

(k) Most gratuities.

The Approximate Retail Value (“ARV”) of the total Experts’ Choice Grand Prize package is $10,200 USD, which will vary depending upon points of departure and destination and seasonal fluctuation of rates and airfares. All other expenses not specifically mentioned herein, including but not limited to, airport taxes and fees, baggage fees, ground transportation not specifically delineated, food, beverages, additional hotel amenities or fees and gratuities, are the responsibility of the Experts’ Choice Grand Prize Winner. Sponsor is not responsible for any cancellations, delays, diversions or substitutions or any act or omissions whatsoever by the air transportation carriers, hotels or other transportation companies or any other persons providing any of these services and accommodations necessitated by same. Sponsor shall not be liable for any loss or damage to baggage and/or personal property. All travel dates are subject to change in Sponsor’s sole discretion. If actual value of the Experts’ Choice Grand Prize is lower than the stated ARV when Prize is procured and fulfilled, then the difference will not be awarded. Travel, hotel and other accommodations are subject to availability. *The Experts’ Choice Grand Prize winner must be willing to share a twin room with another traveler, as single accommodations are not available on this trip. The Sponsor will plan to match the Experts’ Choice Grand Prize Winner with a roommate. If the Sponsor is unable to find a roommate match, the Experts’ Choice Grand Prize Winner will not be charged a single supplement fee. The trip must be fully executed during June, July, August or September of either 2017 or 2018, or the Prize will be forfeited. Certain blackout dates and material restrictions may apply.  Experts’ Choice Grand Prize Winner must sign and agree to Sponsor’s Terms & Conditions.

The People’s Choice Grand Prize Winner, upon the Administrator’s confirmation of eligibility, will receive a 7day/6night trip for one (1) person on the Sponsor’s Classic Polar Bear Photo Adventure starting in Winnipeg, MB, Canada (the “Location”). The Prize package includes:

(a) One (1) roundtrip standard economy airfare ticket from a major commercial airport in the United States or Canada, near the Winner’s primary residence and the Location, as determined by Sponsor (Sponsor reserves the right to substitute ground transportation for air transportation if Winner resides within 150 miles of the Location);

(b) One (1) roundtrip standard economy airfare ticket from the Location to Churchill, MB, Canada;

(c) Accommodations for six (6) nights;

(d) All food and meals during the stay;

(e) Purified drinking water;

(f) Use of cold-weather gear including a parka and boots;

(g) Services of NHA Expedition Leaders and assistants;

(h) Evening wildlife and cultural presentations;

(i) All activities and entrance fees;

(j) Dog sledding excursion;

(k) Airport ground transportation;

(l) Most gratuities.

The Approximate Retail Value (“ARV”) of the total First Prize package is $7,900 USD, which will vary depending upon points of departure and destination and seasonal rates and airfares. All other expenses not specifically mentioned herein, including but not limited to, airport taxes and fees, baggage fees, ground transportation not specifically delineated, food, beverages, additional hotel amenities or fees and gratuities, are the responsibility of the People’s Choice Grand Prize Winner. Sponsor is not responsible for any cancellations, delays, diversions or substitutions or any act or omissions whatsoever by the air transportation carriers, hotels or other transportation companies or any other persons providing any of these services and accommodations necessitated by same. Sponsor shall not be liable for any loss or damage to baggage and/or personal property. All travel dates are subject to change in Sponsor’s sole discretion. If actual value of the Prize is lower than the stated ARV when Prize is procured and fulfilled, then the difference will not be awarded. Travel, hotel and other accommodations are subject to availability. The trip must be fully executed during November of either 2017 or 2018, or the Prize will be forfeited. Certain blackout dates and material restrictions may apply.  People’s Choice Grand Prize Winner must sign and agree to Sponsor’s Terms & Conditions.

The Voting Sweepstakes Winner will receive one (1) $500 prepaid VISA Gift Card. Each Honorable Mention Prize Winner will receive one (1) $150 gift certificate to B&H photography store. Total Prize Pool - $19,800 USD. No substitution, assignment or transfer of the Prize is permitted, except by Sponsor, who reserves the right to substitute any Prize (or Prize component) with another of comparable or greater value.

By accepting a Prize, the Prize Winners agree to release and hold harmless the Released Parties, from and against any claim or cause of action arising out of participation in the Contest or receipt or use of the Prize in question. The two (2) potential Grand Prize Winners will each be notified by phone, or email, and each must sign and return to the Administrator, within seven (7) days of the date of notice or attempted notice is sent, an Affidavit of Eligibility, Liability & Publicity Release in order to claim his/her Prize. Note: The Affidavit sent to the potential (U.S) Grand Prize Winners will each require that the Winners provide their Social Security Number to the Administrator, which will be used solely for tax reporting purposes. All Prize Winners will each be responsible for all local, state, and federal taxes associated with the receipt of their Prize. The Grand Prize Winners must note that the value of their accepted Prize is taxable as income and an IRS Form 1099 will be filed in the name of each Winner for the value of the Prize (applicable to U.S. residents only). The Grand Prize Winners are responsible for obtaining documents necessary for their respective international travel (i.e. passport/visa), if applicable. The Winners are solely responsible for all matters relating to their Prize after it is awarded. If a Prize or Prize notification is returned as unclaimed or undeliverable to a potential Prize Winner, if a potential Prize Winner cannot be reached within three (3) business days from the first notification attempt, or if the potential Grand Prize Winners fail to return requisite document(s) within the specified time period, or if a potential Prize Winner is not in compliance with these Official Rules, then such person shall be disqualified and, at Sponsor’s sole discretion, an alternate Prize Winner may be selected for the Prize at issue.

By accepting a Prize, where permitted by law, the Prize Winners grant to the Released Parties and those acting pursuant to the authority of Sponsor and the Released Parties (which grant will be confirmed in writing upon Sponsor’s request), the right to print, publish, broadcast and use worldwide IN ALL MEDIA without limitation at any time a Winner’s full name, portrait, picture, voice, likeness and/or biographical information for advertising, trade and promotional purposes without further payment or additional consideration, and without review, approval or notification.

IN NO EVENT WILL RELEASED PARTIES BE RESPONSIBLE OR LIABLE FOR ANY DAMAGES OR LOSSES OF ANY KIND (INCLUDING WITHOUT LIMITATION, DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES) ARISING OUT OF PARTICIPATION IN THIS CONTEST OR THE ACCEPTANCE, POSSESSION, USE, OR MISUSE OF, OR ANY HARM RESULTING FROM THE ACCEPTANCE, POSSESSION, USE OR MISUSE OF THE PRIZE.

By participating, Entrants release and agree to hold harmless the Released Parties from any and all liability for any injuries, death or losses or damages to persons or property AS WELL AS CLAIMS/ACTIONS BASED ON PUBLICITY RIGHTS, DEFAMATION, AND/OR INVASION OF PRIVACY that may arise from participating in this Contest or its related activities or the acceptance, possession, use or misuse of, or any harm resulting from the acceptance, possession, use or misuse of the Prize(s). The Prize Winners also acknowledge that Released Parties have neither made nor are in any manner responsible or liable for any warranty, representation or guarantee, express or implied, in fact or in law, relative to the Prize(s).\

USE OF DATA: All information submitted by Entrants will be treated according to Released Parties’ privacy policies, available at http://www.nathab.com/privacy-policy/ and http://www.worldwildlife.org/pages/privacy-policy/.  By entering the Contest and providing their email address and other contact information, Entrants hereby agree to Released Parties’ collection and usage of their personal information and acknowledge that they have read and accepted Released Parties’ Privacy Policy.

DISPUTES: By entering the Contest, Entrants agree that (1) Any and all disputes, claims, and causes of action arising out of or connected with the Contest, or any prizes awarded, shall be resolved individually, without resort to any form of class action; (2) Any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering the Contest but in no event attorneys' fees; and (3) Under no circumstances will any Entrant be permitted to obtain any award for, and Entrant hereby waives all rights to claim punitive, incidental or consequential damages and any and all rights to have damages multiplied or otherwise increased and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, shall be governed by, and construed in accordance with the laws of Colorado without giving effect to any choice of law or conflict of law rules or provisions that would cause the application of the laws of any jurisdiction other than Colorado. The invalidity or unenforceability of any provision of these Official Rules shall not affect the validity or enforceability of any other provision. In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these Official Rules shall otherwise remain in effect and be construed in accordance with their terms as if the invalid or illegal provision were not contained herein. The values of the Prizes set forth above represents Sponsor’s good faith determinations of the ARV thereof and such determinations are final and binding and cannot be appealed.
